Embattled head of Colorado's real estate regulator resigns, plans to work as broker

The embattled head of Colorado's real estate division has resigned after a three month suspension that followed a clash with a state lawmaker.

Erin Toll said Friday that her resignation was effective Monday. She made the announcement in a joint press release with her former boss, Department of Regulatory Agencies chief Barbara Kelley.

DORA spokesman Chris Lines said Toll's suspension and her subsequent lawsuit challenging the way it was handled were resolved in a settlement, but he said he didn't have the terms of the deal. Toll didn't immediately return a call seeking comment.

Toll was suspended in March after she sparred with state Sen. Ted Harvey, a mortgage broker, over a bill that would give a board, not her, the power to oversee mortgage brokers.

Toll then said Harvey and his employer, American Home Funding, were under investigation to determine if they misled consumers with advertising flyers that look like official tax documents.

However, records show that an investigation wasn't launched until the next day. The department has repeatedly said Harvey himself wasn't the target of the probe.

Toll sued Kelley last month, claiming she violated her rights by leaking word of her suspension and ordering her not to talk.

In the resignation announcement, Kelley called Toll a "passionate consumer advocate" and thanked her for her years of service.

Toll said she plans to work as a real estate broker.
